Marketing Services Listing Agreement
1. This agreement dated___________________ between Waterway Realty , Realtors hereafter known as Listing Broker and

5. In consideration of this Marketing Services Agreement, Waterway Realty & Mott Marvin Kornicki, Realtor® hereby agree to:
A)
Place the subject property on the MLS®
System
The official MLS ®,
an entity of The National Association of Realtors.
B) Promote the subject property via the Internet on Realtor.com, Homes.com, AOL & MSN Real Estate, Yahoo, Immobel.com, etc.
6. Asking Price: _______________ Pursuant to the terms of the purchase and sale agreement.
7. Cancellation Policy: At Seller’s request, this listing agreement may be cancelled at no cost by notifying us in writing or by fax

In consideration of the above, the Seller agrees:
· To pay a Listing Fee of $250.00 to WRI
for the services outlined above, this fee is payable upon signing.
· Pay a 2.5% commission to the licensed brokerage who procures a Buyer (Waterway Realty NOT excluded) and Half, (½) of 1% to Waterway Realty for a grand TOTAL of 3%. The commission is based on the actual selling price. In the event that Waterway Realty is the ONLY broker involved seller to pay 2.5% maximum commission.
· To cooperate as best as possible with any licensed
agents and prospective buyers in the showing of the subject property.
· To NOT intentionally solicit a licensed real estate
agent’s prospective "Buyer" who has previously viewed the property.
· To advertise &/or promote this
subject property at the
same asking price as quoted herein- "non-compete" clause.
· To ensure a timely reporting of the sale and pending
sale of the property as required by the MLS,
Seller agrees to forward an executed real estate contract to WRI by Fax or Mail
within 24 hours after the contract
9. Seller hereby acknowledges and represents that no facts that materially affect the value, function or desirability of the subject property, including but not limited to any violation of local or government code. Whether or not said facts are readily observable, the Seller is under a duty to disclose said facts to both Buyer and WRI. Seller has fully reviewed this agreement and warrants the accuracy of all information herein. Seller agrees to hold harmless WRI and those relying on information contained in this agreement for and against damages resulting from any inaccuracy and/or Sellers failure to disclose it. Seller certifies and represents that Seller knows of no such material facts (local government building code violations, unobservable defects, etc.)
11. Seller agrees that under the fair housing act, Seller may not ask or expect the sale of a Sellers property be restricted according to race, color, creed, religion, sex, handicap, familial status, age or national origin.
12. NO GUARANTEE: Seller understands that this agreement does not guarantee the sale of the subject property.

FLORIDA LAW REQUIRES THAT REAL ESTATE LICENSEES
PROVIDE THIS NOTICE TO POTENTIAL SELLERS / LANDLORDS - BUYERS/
TENANTS OF REAL PROPERTY.
You should not assume that any real estate broker or salesperson represents you unless you agree to engage a real estate licensee in an authorized brokerage relationship, either as a single agent or as a transaction broker. This limited confidentiality will prevent disclosure that the seller will accept a price less than the asking or listed price , that a seller or buyer will agree to financing terms other than those offered, or of any other information requested by a party to remain confidential; and
7. Any additional duties that are entered into by this or by separate written agreement.
Limited
Representation means that a buyer or seller is not responsible for the acts of
the licensee. Additionally, parties are giving up their rights to the undivided
loyalty of the licensee. This aspect of limited representation allows a licensee
to facilitate a real estate transaction by assisting both the buyer and the
seller, but a licensee will not work to represent one party to the detriment of
the other party when acting as a transaction broker to both parties.
